Dear Ms. McGregor,
I am in receipt of your Fax letter of May 23, 2000, (dated May 12) in which you conclude, "As a result we have no choice but to continue your suspension for another year..." This statement seemingly contradicts Angela Angel’s letter of 4 June 1999, in which she states three conditions that end with "your suspension will be extended an additional 30 days for each occurrence" (attached). This leads me to interpret the word "year" in your letter dated May 12, 2000, as a typo. Am I correct?
As you have extended my suspension for one year because of my entering the ‘Olelo facility without first making arrangements with one your three designated staff, I would tell you that Marsha Joyner, the show’s producer, phoned ‘Olelo to make the arrangements for me to drop off her tape. None of the three designated staff were available as it was a holiday. Because Ms. Joyner’s tape was extremely time sensitive and was scheduled to air that weekend, Ms Joyner did not have the option of waiting for one of the three to return. Ms. Joyner spoke to Walter Ferreira explaining the situation and that it would be me dropping off the tape. Thus, acting in good faith and doing all that she could in the tight time frame, she obtained permission from the covering staff member for me to enter ‘Olelo to simply drop off the tape. This I did and without incident.
With regard to your accusation of my further violating the terms of my suspension by contacting P. J. O’Reilley to complain about services and request board-related material, the receptionist — who has stated to me her knowledge of my restrictions — forwarded my call to P. J. O’Reilley as the person in charge of the documents I had requested for the public meeting; this in Miki Lee’s absence. Miki Lee was the contact person listed on your Board Agenda web page as responsible for the documents I had requested and Lee was absent the entire day.
With regard to my "Making unfounded and harmful accusations about ‘Olelo’s employment, finance and management practices, and then distributing these inaccuracies broadly without seeking verification of your facts," I find this confusing as this is not a very specific example. I would request your detailing my alleged accusations.

" The specific terms of your suspension
are as follows:
1) You may not be on the premises
of any ‘Olelo facility, including our Mapunapuna, Leeward Community College
(LCC), Wai’anae or Kahuku locations for any reason other for prearranged
drop off or pick up of tapes or for meetings. Arrangements for tape must
be made in advance by contacting your Community Project Manager, David
Mulinix. If you enter the premises of any ‘Olelo facility for any other
purpose, your suspension will be extended an additional 30 days for
each occurrence.
2) You may not operate any ‘Olelo
or LCC equipment for a period of one year. If you operate ‘Olelo or LCC
Equipment during your suspension the length of your suspension will
be extended an additional 30 days for each occurrence.
3) You must clean out your locker
by June 30, 1999......
4) You may call, e-mail or write
only to your Community Project Manager, David Mulinix to arrange for tape
transfer or to arrange for any necessary meetings. Further, you may contact
senior management staff (Lurline McGregor, Miki Lee or myself) for other
legitimate business in writing only. You may not contact any other staff
besides those listed in this paragraph. Staff has been notified of this
and will respond accordingly if contacted. Again, your suspension
will be extended an additional 30 days for each violation of this requirement.

It is with deep regret that I write this letter. I find that I
must take some responsibility for Jeff Garland's extended
suspension. I would have never knowingly compromised a friend. Jeff
and I were working on the Medical
Marijuana video project for the Drug Policy Forum, using Jeff's video
and editing equipment, as we have done for
many years. Due to the nature of the video and the time constraint,
when Jeff completed the editing I asked him if
he would deliver to 'Olelo.
On Good Friday, I called 'Olelo and talked to the only person working
in facilities. I informed him that Jeff was
bringing the tape over for me and could he rush it thru, because we
wanted it aired the following two days. Jeff
took the tape over to 'Olelo and filled out the submission form and
signed my name as I had instructed him.
Sometime later I got a call asking me if Jeff had submitted a tape for
me and had he forged my signature? I replied
that yes he had turned in the tape and no it was not forgery.
Needless to say, with all of the telephone, fax and
e-mails that went on, the program was not aired in a timely manner
as promised.
Now, I find out that Jeff's extended suspension is predicated
upon my asking him to do me a favor. For this, I am
terribly sorry. Since I was at the heart of this situation, I
am asking that you reconsider this extended
suspension.
